What is Bankruptcy?

Bankruptcy is a legal process that allows individuals and businesses to wipe out or pay back some or all of their debt. There are different chapters under which individuals can file for bankruptcy. The most common chapters are 7 & 13.

Chapter 7 Bankruptcy

Chapter 7 allows those who qualify to wipe out certain debt such as credit card debt, medical bills, judgments, unsecured loans, car loans, certain taxes, auto accident claims (except DUI), collection accounts, and judgments. It also allows persons to exempt or keep certain property.

Chapter 13 Bankruptcy

Chapter 13 is used by people with regular income. It allows them to pay off some or all of their debt over time. It can also be used by those who do not qualify for a chapter 7.
